THE FINE PRINT
  • Services must be scheduled and contracts signed a minimum of one month in advance of service start date. Failure to meet this requirement may cause the scheduled service to be rescheduled or cancelled.

  • All purchases are subject to their signed contract.

  • The client agrees to read and follow the contract terms.

  • Completed cover files will be sent only after the service has been paid in full. The final product will be provided as a high resolution PDF or jpeg file.

  • Early termination or cancellations are subject to forfeiture of the deposit..

  • Final payments are non refundable once files are sent.

  • Clients are purchasing a design that will either be an original concept by Atomic Cat or an interpretation of the Client's concept based on Atomic Cat's understanding and available resources. Time frames and dates will be detailed in the contract before the project is started. An estimate of pricing will be provided before the contract is signed. Estimates are subject to change as required.

  • Additional fees that can occur outside the service pricing include. A termination fee. A fee for each additional rough concept, an hourly fee for edits not covered by the original service package, The client may request up to one additional rough concept design if none of the original versions are considered acceptable. The last design must be accepted or purchased as a concept piece if Atomic Cat chooses to continue with one of the original concepts shown or none at all. If none of the concepts are considered acceptable and Atomic Cat  is unwilling to continue further with concepts the project will be considered cancelled. All payments made for the project will be returned except the cancellation fee.

  • Atomic Cat retains the copyrights of all designs, sketches, and concepts worked and/or completed. The copyright notification "Cover design copyright © (year) Atomic Cat Studio" must appear on the copyright page of the publication.The final art cannot be altered without permission from Atomic Cat Studio.

  • The client is purchasing exclusive licensing to display and use the final design for their book packaging (i.e. the book cover) and any other promotional or packaging materials directly related to the book. An extended license would be required for usage outside cover design or marketing or commercial usage unrelated to the book. The client must purchase the separate rights to the final design for usage other than that paid for. Pricing will vary based on the extended license needed and any additional work the new usage may require.  

  • The client does not have rights to any other designs or concepts created during the design process unless they have specifically purchased the rights to these. Atomic Cat has the right to use any rejected or unpurchased files as they choose.The client may not edit, reuse or change the final product in any way without written consent from Atomic Cat. 
     

This agreement is made as of __________(date) between Atomic Cat Studio and __________ (author/client) for the purpose of designing and creating a book cover (eBook, print and/or audiobook) or other art for   __________(title).The Client and Atomic Cat Studio may be referred to herein individually as a “Party” or collectively as the “Parties”. This contract is entered into in good faith. Signature by the Parties indicates acceptance of this contract and the terms described herein.
